As you likely are well aware, San Diego County continues to teeter on the edge of the most restrictive COVID-19 tier because of the adjusted case rate. When the COVID-19 pandemic reached the United States around March of this year, law practices in many areas of the country, including Arizona, were forced to go remote. This (sometimes bumpy) transition raised many concerns for lawyers, top among them being how to get paid by their clients.
Ethical rules, statutes and case law prescribe and proscribe the conduct of California lawyers. In a recent decision, the Court of Appeal, Second District, interpreted the attorney-witness rule and concluded it applies not only at trial but also in the context of pretrial activities.
